General Terms and Conditions

1. Scope & Contractual Partners

These General Terms and Conditions apply to all contracts for the rental of apartments for accommodation concluded between Stadtflucht Homes GmbH and third parties (guests), as well as to all other services and deliveries provided by Stadtflucht Homes GmbH (hereinafter referred to as “Stadtflucht”). The contractual partner of the guest in Germany is always Stadtflucht Homes GmbH, Lindower Straße 18, 13347 Berlin, HRB 243942.

This list is not exhaustive and also includes apartments offered by Stadtflucht Homes GmbH in the future.

For contracts relating to these locations, the following General Terms and Conditions also apply to Stadtflucht Homes GmbH.

All legal relationships between Stadtflucht Homes GmbH and the guest shall be governed exclusively by the laws of the Federal Republic of Germany. If the guest is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with the accommodation contract shall be the registered office of Stadtflucht Homes GmbH. The statutory provisions on the place of jurisdiction shall apply to consumers.

2. Reservations

  • a) Reservation and conclusion of contract

    By making a reservation, the guest offers to conclude an accommodation contract with Stadtflucht Homes GmbH. If the booked apartment is available, the guest will receive a reservation confirmation. This can be issued either directly by Stadtflucht Homes GmbH when booking via our own website or by the respective third-party provider when booking via an external portal. Acceptance of the reservation by Stadtflucht Homes GmbH or by the third-party provider results in the conclusion of an accommodation contract between Stadtflucht Homes GmbH and the guest.

  • b) Offers and contract rejection

    Offers from Stadtflucht Homes GmbH regarding available apartments are subject to change and non-binding. Stadtflucht Homes GmbH reserves the right to refuse to conclude an accommodation contract at its own discretion.

  • c) Restrictions and special conditions

    There is no entitlement to use the accommodation service in a specific apartment. Stadtflucht Homes GmbH reserves the right to define industry-standard restrictions such as minimum stays, booking guarantees or deposits for certain dates. For bookings made via the Stadtflucht Homes GmbH website, the booking confirmation is issued by our channel manager Lodgify.

  • d) Right of withdrawal

    There is no right of withdrawal if contracts for accommodation services are concluded for a specific date or period (§ 312g (2) No. 9 BGB).

3. Cancellation Deadlines

  • a) Guaranteed reservation and cancellation

    A reservation is considered guaranteed once Stadtflucht Homes GmbH has received payment from the guest. For bookings made through external providers, the cancellation conditions specified on their platforms apply. For bookings made directly via the Stadtflucht Homes GmbH website, any deposits already paid may be retained in the event of cancellation. The guest reserves the right to prove that Stadtflucht Homes GmbH has incurred no or significantly less damage. Cancellation of a guaranteed reservation must be made by quoting the reservation number. After the cancellation deadlines have expired, cancellation is no longer possible and Stadtflucht Homes GmbH retains the right to the agreed remuneration, less any expenses saved. This also applies in the event of a no-show by the guest. In the case of guaranteed reservations for several days that are not taken up, all subsequent nights from the second night onwards are forfeited.

  • b) Simple reservations

    Simple reservations, i.e., reservations for which payment has not yet been made by the guest, are valid until 1:00 p.m. on the day of arrival. After 1:00 p.m., such reservations expire automatically and free of charge. In this case, Stadtflucht Homes GmbH is entitled to rent the reserved apartment to another party.

  • c) Late reservations

    For simple reservations received after 1:00 p.m. on the day of arrival, the guest has one hour to make payment in accordance with the payment terms specified in §5.

4. Accommodation Prices & Other Prices

  • a) Applicable prices

    The prices of Stadtflucht Homes GmbH valid at the time of conclusion of the contract are decisive. These prices are gross total prices that include all statutory taxes, fees, and charges. Local taxes that are payable by the guest in accordance with the respective municipal law, such as visitor’s tax, are not included in the price and will be charged separately.

  • b) Individual pricing

    Stadtflucht Homes GmbH applies individual pricing. This means that prices may vary depending on the day and demand, so that the price on one day may be higher or lower than on another day.

  • c) Price adjustments

    In the event of a change in tax, fee, and levy rates, as well as the introduction of new taxes, fees, and levies previously unknown to the parties, Stadtflucht Homes GmbH reserves the right to adjust prices accordingly. In the case of contracts with consumers, this only applies if the period between the conclusion of the contract (booking confirmation) and the price change is more than four months.

5. Payment Terms & Invoicing

  • a) Payment in advance

    The total price for the accommodation services booked with Stadtflucht Homes GmbH must always be paid in advance by the guest.

  • b) Exclusion of offsetting

    Offsetting by the guest is excluded, unless it relates to an undisputed or legally established claim.

  • c) Accepted payment methods

    Stadtflucht Homes GmbH accepts MasterCard, Visa Card, American Express, GiroPay, and SofortÜberweisung as valid payment methods. Cash payments are not possible.

  • d) Subsequent fees

    Stadtflucht Homes GmbH reserves the right to charge the guest’s deposited means of payment with any outstanding amounts for fees incurred through the use of additional services or violations of the General Terms and Conditions.

  • e) Invoicing

    The guest agrees that invoices will generally be made available as downloads or by email. At the guest’s request, the invoice can be sent by post, but delivery times may be longer due to home office regulations and organizational reasons. Stadtflucht Homes GmbH reserves the right to comply with requests for a company stamp or signature on the invoice for the reasons stated above.

6. Use of Reserved Apartments

  • a) Availability of the apartment

    A reserved apartment is available to the guest from 3 p.m. on the day of arrival until 11 a.m. on the day of departure.

  • b) Key handover and return

    Unless otherwise agreed, the transponder keys provided must be handed over to Stadtflucht Homes GmbH or a third party designated by it on the agreed departure date or, if agreed, left in the apartment. If a transponder key is lost or not returned, a fee of €150.00 will be charged for its replacement. Stadtflucht Homes GmbH remains entitled to demand compensation from the guest for any additional damage, in particular if the replacement of the locking system is necessary for security reasons.

  • c) Late Check-out

    A late check-out can be arranged in advance with Stadtflucht Homes GmbH upon request and subject to availability. If a late check-out is approved, Stadtflucht Homes GmbH is entitled to charge EUR 10.00 for each hour or part thereof of additional use of the apartment. For departures after 2:00 p.m., the full daily rate for the apartment will be charged. There is no contractual entitlement to a late check-out.

  • d) Early Check-in

    An early arrival (early check-in) can also be arranged in advance with Stadtflucht Homes GmbH upon request and subject to availability. If early check-in is agreed, Stadtflucht Homes GmbH is entitled to charge EUR 10.00 for each hour or part thereof of additional use of the apartment. There is no contractual entitlement to early check-in.

  • e) Maximum occupancy

    Use of the apartment is permitted exclusively to the persons specified in the booking. The maximum permitted occupancy is based on the information provided in the respective booking offer.

  • f) Visitors and additional guests

    Overnight stays by additional persons are only permitted with the prior consent of Stadtflucht Homes GmbH. Stadtflucht Homes GmbH is entitled to charge additional fees in the event of violations or to terminate the accommodation contract for good cause.

7. Resale

  • a) Prohibition of resale and subletting

    The resale, subletting, or subletting of apartments booked with Stadtflucht Homes GmbH is strictly prohibited. This includes, in particular, the subletting of apartments and/or apartment quotas to third parties at prices higher than those actually set by Stadtflucht Homes GmbH. The assignment or sale of claims against Stadtflucht Homes GmbH is also not permitted. In cases of violation of these provisions, Stadtflucht Homes GmbH is entitled to cancel the booking in question, in particular if the guest has made false statements to third parties about the type of booking or payment.

  • b) Restrictions on use

    The apartments may only be used for accommodation purposes. Any commercial use by the guest is expressly prohibited and may result in legal consequences, including possible prosecution.

8. Liability of Stadtflucht Homes GmbH

  • a) Scope of liability

    Stadtflucht Homes GmbH shall be liable without limitation for damages for which it is responsible resulting from injury to life, limb, or health. Furthermore, Stadtflucht Homes GmbH shall be liable for other damages resulting from intentional or grossly negligent breach of duty. In the case of simple negligence, Stadtflucht Homes GmbH shall only be liable to a limited extent for foreseeable damage typical for this type of contract, provided that a duty has been breached whose fulfillment is essential for the proper execution of the contract and on whose compliance the guest may regularly rely (cardinal duty). A breach of duty by Stadtflucht Homes GmbH is equivalent to a breach by its legal representatives, employees, or vicarious agents. Further claims for damages are excluded, unless otherwise stipulated in these General Terms and Conditions.

  • b) Disruptions and defects

    Should disruptions or defects occur in the services provided by Stadtflucht Homes GmbH, Stadtflucht Homes GmbH will endeavor to remedy the situation upon becoming aware of it or upon immediate complaint by the guest. The guest is obliged to contribute what is reasonable to remedy the disruption and minimize any possible damage. The guest is also obliged to inform Stadtflucht Homes GmbH in good time of the possibility of exceptionally high damage occurring.

  • c) Parking spaces

    If a parking space is made available to the guest, even for a fee, this does not constitute a safekeeping agreement. Stadtflucht Homes GmbH has no obligation to monitor the parking space. Stadtflucht Homes GmbH shall only be liable for loss of or damage to motor vehicles or bicycles parked or maneuvered on the property or their contents in cases of intent or gross negligence. The guest is obliged to report any damage immediately, and obvious damage in any case before leaving the parking facility. Stadtflucht Homes GmbH shall not be liable for damage for which other tenants or other third parties are solely responsible.

  • d) Limitation period for claims

    All claims against Stadtflucht Homes GmbH shall generally become time-barred within one year of the start of the statutory limitation period. This shall not apply to claims for damages or other claims arising from injury to life, limb, or health and/or due to grossly negligent or intentional breach of duty by Stadtflucht Homes GmbH, as well as in the event of breaches of a cardinal obligation.

  • e) Lost property

    Stadtflucht Homes GmbH accepts no liability for lost property, except in cases of intentional or grossly negligent breach of duty. Lost property will only be returned on request for a fee and a processing fee of EUR 10.00. Stadtflucht Homes GmbH undertakes to store lost property for a period of six months.

9. Security Deposit

  • a) General provisions

    To secure all claims of Stadtflucht Homes GmbH against the guest arising from the accommodation contract, the guest is obliged to provide a security deposit before the apartment is handed over.

  • b) Security deposit for short-term stays

    In the case of an agreed stay of less than three months, the security deposit to be provided amounts to 20% of the total amount of the accommodation price.

  • c) Security deposit for longer stays

    For an agreed stay of three to six months, a security deposit amounting to two months’ rent must be provided.

  • d) Pre-authorization and failure to provide security

    For a rental period of less than three months, Stadtflucht Homes GmbH may pre-authorize the guest’s payment card to secure the security deposit. If the security deposit is not provided by the time the apartment is handed over, the guest shall have no claim to the handover of the apartment. If Stadtflucht Homes GmbH has nevertheless handed over the apartment to the guest and the deposit is not paid within a reasonable period set by Stadtflucht Homes GmbH, Stadtflucht Homes GmbH shall be entitled to terminate the accommodation contract without notice.

  • e) Settlement of the deposit

    Stadtflucht Homes GmbH is obliged to settle the deposit within one month of the termination of the accommodation contract.

10. Guest Data

  • a) Collection of contact details

    In order to ensure effective communication with the guest, Stadtflucht Homes GmbH requires the guest’s email address and telephone number. To verify the guest’s identity, Stadtflucht Homes GmbH is entitled to request a valid identification document (for domestic guests, an identity card or passport; for foreign guests, a passport) and valid credit card details digitally at check-in.

  • b) Cancellation in case of unclear identity

    If the identity of a guest cannot be verified beyond doubt due to missing or incorrect documents, Stadtflucht Homes GmbH is entitled to cancel the booking.

  • c) Newsletter registration at check-in

    At the check-in, guests are asked to provide their details so that they can register for the Stadtflucht Homes GmbH newsletter. By registering for the newsletter, guests receive regular news and information about offers and services from Stadtflucht Homes GmbH. Registration for the newsletter is voluntary and based exclusively on the guest’s separate consent. This consent can be revoked at any time with effect for the future.

11. Termination of the Accommodation Contract

  • a) Right of termination by Stadtflucht Homes GmbH

    Stadtflucht Homes GmbH is entitled to terminate the accommodation contract for good cause. Good cause shall be deemed to exist in particular if (i) force majeure or other circumstances beyond the control of Stadtflucht Homes GmbH make it impossible to fulfill the contract, (ii) apartments are booked culpably under misleading or false information or by concealing essential facts; essential facts may include, but are not limited to, the identity of the guest, their solvency, or the purpose of their stay, (iii) Stadtflucht Homes GmbH has reasonable grounds to believe that the use of the service may jeopardize the smooth operation, security, or public reputation of Stadtflucht Homes GmbH and its locations, without this being attributable to the sphere of control or organization of Stadtflucht Homes GmbH, (iv) the purpose or reason for the stay is unlawful, or (v) in the event of resale, subletting, and/or re-letting in accordance with the provisions of Section 7.

  • b) Notification of the guest

    Stadtflucht Homes GmbH must inform the guest immediately of the exercise of the right of termination.

  • c) No claim for damages

    In the event of justified termination of the accommodation contract by Stadtflucht Homes GmbH, the guest shall have no claim for damages.

12. No Smoking in the Apartment

  • a) Smoking ban

    Stadtflucht Homes GmbH apartments are non-smoking apartments. Smoking is therefore strictly prohibited in the communal areas, in the guest apartments, and on the balconies and/or terraces. In the event of a violation of the smoking ban in non-smoking apartments, Stadtflucht Homes GmbH is entitled to take the necessary measures to restore the apartment to its contractual condition. This may require special cleaning, such as professional odor neutralization or ozone treatment. The actual costs incurred for this, as well as any loss of rent due to the temporary unavailability of the apartment, may be charged to the guest. Depending on the extent of the damage, the costs of such special cleaning can reach or exceed an amount of approximately EUR 1,500.00. The guest reserves the right to prove that no damage or significantly less damage has been incurred. This amount of compensation may be increased if Stadtflucht Homes GmbH can prove that the damage was greater.

  • b) Safety regulations

    Tampering with or blocking emergency exits, fire extinguishers, or the fire alarm is strictly prohibited. Violations will result in a penalty fee of EUR 150.

13. No-Party Policy

  • a) Parties prohibited

    Holding parties in the apartments of Stadtflucht Homes GmbH is not permitted.

  • b) Compensation for damages in the event of violation

    In the event of a violation, Stadtflucht Homes GmbH has the right to demand compensation from the guest for the additional cleaning costs incurred and any loss of revenue resulting from the inability to rent the apartment, in the amount of EUR 2,000.00. This amount of compensation may be increased if Stadtflucht Homes GmbH can prove that the damage was greater.

  • c) Nighttime quiet hours

    The statutory nighttime quiet hours must be observed. In particular, noise disturbances must be avoided between 10:00 p.m. and 7:00 a.m. In the event of repeated or significant violations of the house rules or quiet hours, Stadtflucht Homes GmbH is entitled to terminate the accommodation contract without notice.

14. Damage or Theft

In the event of damage exceeding normal wear and tear, or in the event of theft, Stadtflucht Homes GmbH has the right to charge the guest for the damage and the separate costs of repairing the damage, including any loss of revenue resulting from the apartment being unavailable for rental as a result.

15. Pets

A maximum of one pet per apartment is permitted in Stadtflucht Homes GmbH apartments. A surcharge of €25 per day will be charged for each pet. Animals are only permitted with prior notification and approval from Stadtflucht Homes.

Bringing additional pets must be discussed with and approved by Stadtflucht Homes GmbH in advance.

16. Maintenance

  • The guest undertakes to treat the apartment provided to them, as well as the furnishings and the rooms, facilities and equipment intended for shared use, with care and consideration.
  • Upon moving into the apartment, the guest must check the furnishings for completeness and suitability for use and report any defects to Stadtflucht Homes GmbH immediately.
  • The guest is liable for all damage caused by him or his visitors through culpable use contrary to the contract, unless this is due to normal wear and tear.
  • Final cleaning and commissioned cleaning of the apartments is carried out by Stadtflucht Homes GmbH. The guest grants the commissioned service provider access to the apartment.

17. Media Equipment

Stadtflucht Homes GmbH offers guests the opportunity to borrow various media equipment such as projectors with screens and televisions. These items may be borrowed by arrangement and subject to availability.

The borrowed equipment must be returned in the same condition as it was received. In the event of damage or loss of the equipment, corresponding fees will be charged, which correspond to the actual costs of repair or replacement.

18. Internet Use

  • Stadtflucht Homes GmbH shall provide the guest with Internet access where possible. Disruptions, e.g. due to force majeure or maintenance measures, cannot be ruled out.
  • The guest undertakes not to misuse the Internet connection and to observe all copyrights, patents, names, trademarks and personal rights of third parties. In the event of illegal use of the Internet connection by the guest or by third parties, the guest shall be liable for all resulting damages.
  • Passing on the access data for the Internet connection to third parties is prohibited. In the event of a violation, the guest shall be liable for all damages incurred.
  • In the event of legal violations, Stadtflucht Homes GmbH reserves the right to block the guest’s Internet connection.

19. Data Protection

The data protection provisions of Stadtflucht Homes GmbH can be viewed at the corresponding URL provided on the Stadtflucht Homes GmbH website.

20. Severability Clause

Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions. In place of the invalid or unenforceable provision, a legally permissible provision that comes closest to the economic purpose of the invalid provision shall be deemed to have been agreed.
